AGREEMENT

These definitions should help you understand this policy. When we say “we,” “us,” “our,” and “Bodhi Core,” we are referring to Bodhi Core, Inc. Fatoş Seda Bulut, Istanbul. We provide online platforms that you may use to market to, sell to, keep track of data related to, or stay in contact with others, related to your customers (the “Services”). When we say “client,” we are referring to the person or entity that is registered with us to use the Services. When we say “you,” we are referring either to a client or to some other person who visits any of our Websites. A “customer” is a person you contact through our Services, or a person who you might choose to contact at some point in the future through the use of our Services. In other words, a customer is anyone on your customer list or about whom you have given us information. “Personal Information” means any information that identifies or can be used to identify you or a customer, directly or indirectly, including, but not limited to, first and last name, date of birth, email address, gender, occupation or other demographic information. A “customer list” is a list of customers and all associated information related to those customers (for example, email addresses).

ACCEPTANCE OF TERMS

• This Agreement sets forth legally binding terms for your use of Bodhi Core. By using Bodhi Core, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse Bodhi Core, without access to content) or you are a “Member” (which means that you have registered as a user).
  If you do not accept the terms of this Agreement, you should leave Bodhi Core and discontinue use of the Service immediately. We may modify this Agreement from time to time, and such modification shall be effective upon its posting on Bodhi Core.
  You agree to be bound by any modification to this Agreement when you use Bodhi Core after any such modification is posted; it is therefore important that you review this Agreement regularly.
• Please ensure that you read this agreement carefully as not only does it form the legal relationship between us, it also provides useful information about the practical side of your classes. [When you sign this agreement (or if you fail to do so, by attending the first class or session)] OR (If you are booking and paying online) after our acceptance of your order will, this document will constitute a legally binding agreement between us.
• In participating in online classes, you agree to the terms and conditions as outlined here.
• We are not medical professionals and cannot advise on whether you should join the classes or not. If you have any concerns at all about your health and undertaking the classes, you should consult your doctor or other medical professional.
• You understand that when participating in any exercise or exercise program, there is the possibility of physical injury. If you engage in our live online classes or our pre-recorded videos, you agree that you do so at your own risk, are voluntarily participating in these activities and assume all risk of injury to yourself.
• Make sure you exercise in a large well-lit area that is free from obstacles and that you wear comfortable clothing that doesn’t inhibit movement.
• Stop exercising and consult your physician if you feel dizzy, faint, light-headed or if you experience any discomfort.
• Only you can monitor your condition during your workout. You are responsible for exercising within your limits and seeking attention and advice as appropriate.

 

PAYMENTS, CANCELLATIONS & REFUNDS

• Memberships must be purchased by an upfront payment. The membership cannot be activated prior to full payment.
• PLEASE NOTE: should you decide to cancel your subscription, the subscription will terminate at the time of cancellation. Please proceed to cancel 1-2 days prior to the renewal date of your subscription to ensure you still have access to class/videos.
• All membership bundles which have commenced are non-refundable to clients. No refunds, transfers, suspensions or extensions are offered on unused portions of passes due to illness, user error, injury, change of address or any other reason.
• Membership entitles clients to attend unlimited classes over the duration of the membership.
• Membership fees will be charged automatically via direct debit to your credit card or bank account according to your billing cycle via www.bodhicore.com, unless you cancel before your next billing date.
• Bodhi Core in no way responsible for additional bank fees that you may incur from your bank. Bank fees are under the terms and conditions of contractual agreements that lie between you and your bank.
• Fees may increase from time to time to reflect increases in costs.
• In attending classes at Bodhi Core, you agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Bodhi Core for any personal injury.
• Subscriptions made through our website are final, no refunds or exchanges can be given, so please be sure of your purchase.
• All memberships, once booked, are non-refundable, non-changeable and not transferable to another person. These terms are applicable to everyone in all circumstances.

Live CLASSES

• The Classes will take place at the times and on the dates set out in our schedule on our website. We reserve the right to not offer live classes, change our timetable and scheduled classes and will provide you with as much notice as possible of this. Please ensure that your email address and other contact details are up to date at all times. We may post revisions to the timetable or the scheduled classes on our website bodhicore.com so please check our website regularly.

LIABILITY

• Nothing in this agreement shall limit liability for death or personal injury caused by negligence or by fraud or fraudulent misrepresentation or for any matter for which liability cannot be legally excluded or limited.
• The services shall be provided with due care, skill and ability. Other than this, all warranties and representations are excluded to the fullest extent permitted by law. You must make us aware of any medical condition that may impact upon your ability to participate in the classes or that may impact on your health in the classes.
• There shall be no liability for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of corruption of data or information or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses suffered or incurred by you as a result of you entering into this agreement.
• Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of this agreement shall in all circumstances be limited to the total price paid by you for the classes in the 12 months preceding any claim.
• If we are prevented from or delayed in performing my obligations by your act or omission or by any circumstance outside of my control, we shall not be liable to you for any costs, charges or losses sustained or incurred by you that arise directly or indirectly from such prevention or delay.
• The provisions of this liability section shall survive termination of this agreement.

GENERAL

• This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with Türkiye law. The parties irrevocably agree that the courts of Türkiye shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
• Commitment to Data Security, your personally identifiable information is kept secure. All emails and newsletters from our sites allow you to opt out of further mailings. Bodhi Core will never sell trade, rent, exchange or otherwise share your personal information with any other person, company or organization.
• If you wish to become a Member and make use of the Service, you must read this Agreement and indicate your acceptance during the registration process. In consideration of your use of the Service, you represent that you are of legal age to form a binding contract.
  You also agree to:
  (a) provide true, accurate, current and complete information about yourself as prompted by the registration form available on Bodhi Core (the “Registration Data”) and(b) maintain and promptly update your Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, bodhicore reserves the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof) at any time.
  Use of the Service and membership on Bodhi Core is void where prohibited.
  Content on Bodhi Core is provided to you “AS IS” for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of Bodhi Core.

Bodhi Core reserves all rights not expressly granted in Bodhi Core and the Content. You may access Bodhi Core and Content as available:
for your information and personal use;
– as intended through the normal functionality of the Studio Online Service; and
– for Streaming, (“Streaming” or “Stream” means a contemporaneous digital
transmission of an audiovisual work via the Internet from the Service to a user’s
device in such a manner that the data is intended for real-time viewing and not intended to be copied, stored, permanently downloaded, or redistributed by the user).
Accessing Bodhi Core videos for any purpose or in any manner other than Streaming is expressly prohibited.

HEALTH DISCLAIMER

Physical exercise, in all of its forms and with or without the use of equipment such as bands, rings or any other equipment that may be suggested by a Bodhi Core instructor, is a strenuous physical activity. Accordingly, you are urged and advised to seek the advice of a physician before beginning any physical exercise regimen, routine, program or using any suggested equipment, shown in any of the video clips on Bodhi Core.

Bodhi Core is not suitable for those who are currently or may be pregnant. Bodhi Core is not a medical organization and its instructors or staff cannot give you medical advice or diagnosis. All suggestions and comments relating to the use of equipment, poses, moves and instruction are not required to be performed by you and are carried out at your election while viewing Bodhi Core videos.
Nothing contained in Bodhi Core should be construed as any form of such medical advice or diagnosis.

By using Bodhi Core you represent that you understand that physical exercise involves strenuous physical movement, and that such activity carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities.
It is your responsibility to ensure that by participating in classes and activities on the Bodhi Core, you will not exceed your limits while performing such activity, and you will select the appropriate level of classes for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have.
You understand that, from time to time instructors may suggest physical adjustments or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition.
You expressly waive and release any claim that you may have at any time for injury of any kind against Bodhi Core, or any person or entity involved with Bodhi Core, including without limitation its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates and representatives.

MINORS

Bodhi Core’s content is not directed to persons under eighteen (18) years of age, and by providing information about yourself to Bodhi Core you are representing that you are eighteen (18) years of age or older.

MEMBER ACCOUNT, PASSWORD AND SECURITY

If you register on the Bodhi Core, you will be required to choose a password and user name, and you may be asked for additional information regarding your account, such as your e-mail address. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account.
You agree to
(a) immediately notify Bodhi Core of any unauthorized use of your password or account or any other breach of security, and(b) ensure that you log out from your account at the end of each session. You may never use another Member’s account without prior authorization from Bodhi Core. Bodhi Core will not be liable for any loss or damage arising from your failure to comply with this Agreement.

PROHIBITED CONDUCT

You agree not to use the Service to post or otherwise transmit information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials (“Content” means the transmission of information, data, text, software, music, sound, photographs, graphics, video, messages, tags or other materials generated by a user) that:
Is patently offensive and/or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual
Harasses or advocates harassment of another person
Exploits people in a sexual or violent manner
Contains nudity, violence, pornography, sexually explicit material or offensive subject matter
Provides any telephone numbers, street addresses, last names or email addresses of anyone other than your own
Promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous
Violates any intellectual property or other proprietary right of any third party, including Content that – – promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files
Involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” or “spamming”
Contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page)
Furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone’s privacy, or – – providing or creating computer viruses
Solicits passwords or personal identifying information from other Members
Involves commercial activities and/or sales without Bodhi Core prior written consent, such as contests, – – sweepstakes, barter, advertising, and/or pyramid schemes
Includes a photograph of another person that you have posted without that person’s consent or otherwise – constitutes an invasion of an individual’s privacy or infringement of publicity rights
Denigrates, ridicules, or demeans another person
Contains a virus or other harmful component.
You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” that accesses Bodhi Core in a manner that sends more request messages to the Bodhi Core servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser.

RESPONSIBILITY FOR CONTENT

You, and not Bodhi Core, are entirely responsible for all Content that you post, email, transmit or otherwise make available via Bodhi Core. Bodhi Core does not control the Content posted by any Members and, as such, we do not guarantee the accuracy, integrity or quality of such Content.
You understand that by using the Service, you may be exposed to Content that you deem offensive, indecent or objectionable. Under no circumstances will Bodhi Core be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred at any time as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

REJECTION/REMOVAL OF CONTENT

You acknowledge that Bodhi Core may or may not pre-screen Content posted on the Bodhi Core, that Bodhi Core is not responsible for behavior or comments of teachers and/or students and/or music on the Online Studio, but that Bodhi Core shall have the right (but not the obligation) in its sole discretion to pre-screen, edit, refuse, or remove any Content or portion thereof that is available via the Service, for any reason.
Without limiting the foregoing, Bodhi Core shall have the right to remove from Bodhi Core any Content that violates this Agreement or is otherwise objectionable in the sole discretion of Bodhi Core. If you become aware of misuse of the Service by any person, please contact Bodhi Core.

TERMINATION OR SUSPENSION OF ACCOUNT

You agree that Bodhi Core may at any time and for any reason, including a period of account inactivity, terminate your access to Bodhi Core Services, or restrict or suspend your access to all or any part of the Service at any time, for any or no reason, with or without prior notice, and without liability.

PRESERVATION/DISCLOSURE

You acknowledge, consent and agree that Bodhi Core may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to:
(a) comply with legal process nationally or internationally
(b) enforce this Agreement
(c) respond to claims that any Content violates the rights of third parties
(d) respond to your requests for customer service
(e) protect the rights, property or personal safety of Bodhi Core, its Members and the public; or(f) pursuant to the terms of the Privacy Policy.

SECURITY COMPONENTS

You understand that Bodhi Core and software embodied within Bodhi Core may include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by Bodhi Core and/or content providers who provide content to Bodhi Core. You may not attempt to override, disable, circumvent or otherwise interfere with any such security components and usage rules embedded into Bodhi Core.

PROPRIETARY RIGHTS

All materials on Bodhi Core, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software and other elements (collectively, “Material”) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Bodhi Core or by third parties that have licensed or otherwise provided their material to Bodhi Core.
You acknowledge and agree that all Materials on Bodhi Core are made available for limited, non-commercial, personal use only. Except as specifically provided herein or elsewhere on Bodhi Core, no Material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without Bodhi Core prior express written permission.
You may not add, delete, distort, or otherwise modify the Material. Any unauthorized attempt to modify any Material, to defeat or circumvent any security features, or to utilize Bodhi Core or any part of the Material for any purpose other than its intended purposes is strictly prohibited.

NON-COMMERCIAL USE

The Service may not be used in connection with any commercial purposes, except as specifically approved by Bodhi Core. Unauthorized framing of or linking to Bodhi Core is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles and Content without notice and may result in termination of membership privileges.

LICENSE TO YOUR CONTENT

By posting, displaying, publishing, transmitting, or otherwise making available (individually and collectively, “Posting”) any Content on or through Bodhi Core or the Service, you hereby grant to Bodhi Core a non-exclusive, fully-paid, royalty-free, perpetual, irrevocable, worldwide license (with the right to sublicense through unlimited levels of sublicensees) to use, copy, modify, adapt, translate, create derivative works, publish, publicly perform, publicly display, store, reproduce, transmit, distribute, and otherwise make available such Content on and through the Bodhi Core, in print, or in any other format or media now known or hereafter invented, without prior notification, compensation, or attribution to you, and without your consent.
If you wish to remove any Content from the Service, your ability to do so may depend on the type of Content, the location and manner of Posting, and other factors.
You may contact us to request the removal of certain Content you have Posted, but Bodhi Core has no obligation to remove any such Content, may choose whether or not to do so in its sole discretion, and makes no guarantee as to the complete deletion of any such Content and copies thereof.
Notwithstanding the foregoing, a back-up or residual copy of any Content Posted by you may remain on Bodhi Core’s servers after the Content appears to have been removed from Bodhi Core, and Bodhi Core retains the rights to all such remaining copies.
You represent and warrant that:
(a) you own all right, title and interest in all Content posted by you on or through Bodhi Core or the Service, or otherwise have the right to grant the license set forth in this section, and(b) the Posting of your Content on or through Bodhi Core or Service does not violate the privacy rights, publicity rights, copyrights, publishing, trademarks, patents, trade secrets, contract rights, confidentiality, or any other rights of any third party.

BODHİ CORE AND THIRD PARTIES

Bodhi Core contains Content of Bodhi Core and Content of third-party licensors, which is protected by copyright, trademark, patent, trade secret and other laws. Bodhi Core owns and retains all rights, title and interest in Bodhi Core Content.
Bodhi Core hereby grants to you a limited, revocable, non-sublicensable license to stream and/or view Bodhi Core Content and any third party Content located on or available through the Online Studio or Service (excluding any software code therein as set forth above) solely for your personal, non-commercial use in connection with viewing the Online Studio and using the Service.
Except for Content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, make available, or sell any Content appearing on or through the Online Studio or Service.
Any dealings with third parties included within or on the Bodhi Core involving the delivery of and payment for goods and services, or any other terms, conditions, warranties, or representations associated with such third parties, are solely between you and that third party.
Bodhi Core is neither responsible nor liable for any part of such dealings or promotions. Any reference to any third party or the products or services of any third party on Bodhi Core does not constitute an endorsement or recommendation of such third party or the product or services of such third party by Bodhi Core or any of its employees, officers, independent contractors, agents or other representatives.
Any reference to any third party on Bodhi Core is provided to you for informational purposes only. Bodhi Core encourages you to conduct your own research and due diligence regarding such third parties and their products and services.
While Bodhi Core works to ensure the information on Bodhi Core is current and accurate, Bodhi Core does not warrant the accuracy of any information contained on Bodhi Core (including information provided by instructors) or its fitness for any particular purpose.

OTHER SITES

Bodhi Core may contain links to other sites owned by third parties (i.e. advertisers, affiliate partners, strategic partners, or others). We are not responsible for examining or evaluating, and we do not warrant the products or offerings of, any of these businesses or individuals, or the accuracy of the content of their websites. Bodhi Core does not assume any responsibility or liability for the actions, product, and content of any such website.
Before you use any third party website, you should review the applicable terms of use and policies. The inclusion of a link in any of the websites does not imply Bodhi Core endorsement of such third party. If you decide to access any such linked websites, you do so at your own risk.

INTERNATIONAL USE

Due to the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from Turkey or the country in which you reside.

PRIVACY POLICY

Bodhi Core respects your privacy and permits you to control certain aspects of the treatment of your personal information as set forth in Bodhi Core’s Privacy Policy.
A complete statement of the current privacy policy can be found in Bodhi Core Privacy Policy. The Privacy Policy is expressly incorporated into this Agreement by this reference.

INFRINGEMENT POLICY

Bodhi Core reserves the right in its sole discretion to immediately suspend and/or terminate access to the Service or Bodhi Core by any user who is alleged to have infringed on the intellectual property rights of Bodhi Core or of a third party, or otherwise violated any intellectual property laws or regulations.
Bodhi Core policy is to investigate any allegations of copyright infringement brought to its attention. If you have evidence, know, or have a good faith belief that your rights or the rights of a third party have been violated and you want Bodhi Core to delete, edit, or disable the material in question, you must provide Bodhi Core with all of the following information:
(a) a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
(b) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
(c) identification of the material that is claimed to be infringed or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Bodhi Core to locate the material;
(d) information reasonably sufficient to permit Bodhi Core to contact you, such as an address, telephone number, and if available, an electronic mail address at which you may be contacted;
(e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and(f) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
For this notification to be effective, you must provide it to Bodhi Core by e-mail with a return receipt acknowledgement.

MEMBER DISPUTES

You are solely responsible for your interactions with other Members. Bodhi Core reserves the right, but has no obligation, to monitor or mediate disputes between you and other Members.

TERM AND TERMINATION

This Agreement shall remain in full force and effect for so long as it is posted on Bodhi Core. You may terminate your membership at any time, for any reason, by following the instructions on the Online Studio. If you cancel your membership before the end of the applicable billing cycle, your account will be cancelled as of the following month. You will not receive a refund for the current billing period.
Bodhi Core reserves the right to terminate your account or your access to Bodhi Core immediately, with or without notice to you, and without liability to you, if Bodhi Core believes that you have breached any of the terms of this Agreement, furnished Bodhi Core with false or misleading information, or interfered with use of Bodhi Core or the Service by others.
When you close or deactivate your account or if your account is otherwise terminated, we have the right, but not the obligation, to store your personal information, settings, saved and completed classes, and teachers you have followed unless we have exercised our right to terminate your account, you can re-activate your account at any time by contacting us.

MEMBERSHIP

No Sharing. Members of Bodhi Core may not share, give or sell their password or username to any other person or entity. Excessive viewings or logins by any Member will be construed by Bodhi Core as fraudulent use of the Online Studio, which will result in the immediate cancellation of membership without refund. When becoming a Member, you agree to take all actions possible to protect your username and password from fraudulent use.
Bodhi Core reserves the right to cancel any membership it believes has been compromised, or is being used fraudulently, at its own discretion.
Memberships are billed monthly. All memberships are renewed automatically until cancelled. If membership is terminated due to a violation of this Agreement, Bodhi Core will not reimburse the Member for the remainder of any paid month, nor will reimbursements be made for membership cancellations prior to any monthly renewal date. Members may cancel their membership at any time. Membership must be cancelled prior to the renewal date in order to end membership charges.
When you purchase a membership subscription, you will initially be charged at the rate applicable at the time of your agreement to subscribe. Bodhi Core has the right to increase the price of the subscription.

DISCLAIMER OF WARRANTIES

You agree that your use of Bodhi Core shall be at your sole risk. Bodhi Core and the materials are provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permitted by law, Bodhi Core, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with Bodhi Core and your use thereof.
Bodhi Core makes no warranties or representations about the accuracy or completeness of this Bodhi Core’s content or the content of any sites linked to this website and assumes no liability or responsibility for any
(i) errors, mistakes, or inaccuracies of content,
(ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of Bodhi Core,
(iii) any unauthorized access to or use of Bodhi Core secure servers and/or any and all personal information and/or financial information stored therein,
(iv) any interruption or cessation of transmission to or from Bodhi Core,
(v) any bugs, viruses, trojan horses, or the like which may be transmitted to or through Bodhi Core by any third party, and/or(vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via Bodhi Core.
Bodhi Core does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through Bodhi Core or any hyperlinked websites or featured in any banner or other advertising, and bodhi Core will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services.
As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

LIMITATION ON LIABILITY

In no event shall Bodhi Core, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any
(i) errors, mistakes, or inaccuracies of content,
(ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Bodhi Core,
(iii) any unauthorized access to or use of Bodhi Core secure servers and/or any and all personal information and/or financial information stored therein,
(iv) any interruption or cessation of transmission to or from Bodhi Core,
(v) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through Bodhi Core by any third party, and/or(vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via Bodhi Core, whether based on warranty, contract, tort, or any other legal theory, and whether or not Bodhi Core is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
You specifically acknowledge that Bodhi Core shall not be liable for content posted by users or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.
Any reference to a person, entity, product, or service on Bodhi Core does not constitute an endorsement or recommendation by Bodhi Core or any of its employees.
Bodhi Core is not responsible for any third party content on Bodhi Core or third party web page accessed from this website, nor does Bodhi Core warrant the accuracy of any information contained in a third party website or its fitness for any particular purpose.
No communication of any kind between you and Bodhi Core or a representative of Bodhi Core shall constitute a waiver of any limitations of liability hereunder or create any additional warranty not expressly stated in the terms of use.
Bodhi Core reserves the right to remove any material posted on Bodhi Core that it determines in its sole discretion is violative of any law or right of any person, infringes the rights of any person, or is otherwise inappropriate for posting on Bodhi Core.

EXCLUSIONS AND LIMITATIONS

Those who access or use Bodhi Core from other jurisdictions do so at their own volition and are responsible for compliance with local law. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, in certain jurisdictions, some of the above limitations of liability may not apply to you; all other provisions of this Agreement remain in full force and effect.

INDEMNITY

You agree to defend, indemnify and hold harmless Bodhi Core, its subsidiaries, affiliates, subcontractors, officers, directors, employees, consultants, representatives and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees and costs) arising from
(i) your use of and access to Bodhi Core;
(ii) your violation of any term of this Agreement;
(iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or(iv) any claim that one of your submissions of Content caused damage to a third party. This defense and indemnification obligation will survive this Agreement and your use of Bodhi Core.

MODIFICATION AND DISCONTINUATION

We reserve the right at any time to modify, edit, delete, suspend or discontinue, temporarily or permanently the Service or any of the Online Studio (or any portion thereof) with or without notice. You agree that we will not be liable to you or to any third party for any such modification, editing, deletion, suspension or discontinuance of the Service or the Online Studio.

ASSIGNMENT

This Agreement and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Bodhi Core without restriction.

INTEGRATION CLAUSE

This Agreement together with the Privacy Policy and any other legal notices published by Bodhi Core on Bodhi Core website, shall constitute the entire agreement between you and Bodhi Core concerning Bodhi Core and governs your use of the Bodhi Core and Service, superseding any prior agreements between you and Bodhi Core with respect to Bodhi Cores and Services.

WAIVER AND SEVERABILITY OF TERMS

The failure of Bodhi Core to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

STATUTE OF LIMITATIONS

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of Bodhi Core, the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

GOVERNING LAW AND VENUE

This Agreement shall be governed by the laws of Turkey, without respect to its conflict of laws principles. Any claim or dispute between you and Bodhi Core that arises in whole or in part from the Online Studio shall be decided exclusively by a court of competent jurisdiction located in Turkey.

ABILITY TO ACCEPT TERMS OF SERVICE

You affirm that you are at least eighteen (18) years of age, and are fully able and competent to enter into this Agreement, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement, and to abide by and comply with this Agreement.

GENERAL

Bodhi Core reserves the right to amend this Agreement at any time and without notice, and it is your responsibility to review this Agreement for any changes. Your use of Bodhi Core following any amendment of this Agreement will signify your assent to and acceptance of its revised terms.

TARAFLAR

İşbu Üyelik Sözleşmesi (bundan sonra “Sözleşme” olarak anılacaktır.) Bodhicore ile www.bodhicore.com adresinden ve/veya mobil cihaz, akıllı televizyon ve benzeri cihazlar üzerinde yer alan uygulamalarından bodhicore’un sunduğu ücretli ve/veya ücretsiz video, müzik, canlı TV yayını, oyun ve benzeri içerik hizmetlerinden (bundan sonra “Dijital İçerik” olarak anılacaktır) kendisi ve/veya kanuni temsilcisi olduğu küçükler için faydalanmak amacıyla işbu Sözleşmeyi onaylamak isteyen tüketici (bundan sonra “ALICI” olarak anılacaktır) arasında ALICI’nın elektronik ortamda bulunan “Üyelik Sözleşmesini Kabul Ediyorum” butonunu tıklaması ve kabul beyanının bodhicore kayıtlarına geçtiği an kurulmuş ve yürürlüğe girmiştir.

ÖN BİLGİLENDİRME TEYİDİ

ALICI, Mesafeli Sözleşmeler Yönetmeliği’ne uygun olarak satışa konu dijital içerik hizmetlerin temel nitelikleri, bedelsiz olup olmadığı satış bedeli, ödeme şekli ve diğer tüm hususlarda bilgi sahibi olduğunu ve kendisine ön bilgilendirmenin yapılmış olduğunu ve işbu Sözleşme’nin bağlayıcı olduğunu kabul ve beyan eder. Mesafeli Sözleşmeler Yönetmeliği’ne uygun olarak dijital içerik hizmetlerin temel nitelikleri, bedeli, ödeme şekli ve diğer tüm hususlar uygulamada yer almaktadır.

SÖZLEŞME KONUSU HİZMETLER VE ÖZELLİKLERİ

İşbu Sözleşmenin konusu ALICI’nın, Dijital İçerik Hizmetleri’ne abone olmasının şekil ve şartlarının ve tarafların karşılıklı hak ve yükümlülüklerinin tespitidir.

Dijital İçerik Hizmetleri’nin özellikleri ve kullanım koşulları www.bodhicore.com adlı web sitesindeki tanıtım sayfasında ve/veya uygulama ekranında belirtildiği gibidir.

İşbu Sözleşme ile www.bodhicore.com adresinde ve/veya mobil cihaz, akıllı televizyon ve benzeri cihazlar üzerinde yer alan uygulamalarından bodhcore’un sunduğu ve kendisinin tek taraflı takdir hakkına bağlı olarak belirlenecek Dijital İçerik Hizmetlerini, seçilen hizmet kategorisine ilişkin lisans sınırlamaları dahilinde, önceden belirtilen fiyat ve koşullarda ALICI’ya sunmayı; ALICI’da kullanım şartlarını kabul ederek hizmet bedelini tam ve zamanında bodhicore’a ödemeyi taahhüt eder.

ALICI, Dijital İçerik Hizmetleri’nin fiziksel bir teslimatının olmadığını, gayri maddi nitelikte olan Dijital İçerik Hizmetleri’nin elektronik ortamda sunulacağını ve teslim edileceğini kabul eder.

SÖZLEŞME TARİHİ

İşbu Sözleşme, ALICI tarafından Sözleşme’nin okunduğunun ve kabul edildiğinin beyan edilmesiyle akdedilmiş olup ve bu andan itibaren hüküm ve sonuç doğuracaktır.

ÜYELİK İŞLEMLERİ

ALICI, kayıt sırasında vermiş olduğu elektronik posta adresi ile bir üyelik oluşturma imkanına sahiptir. Aynı elektronik posta adresi ile birden fazla üyelik oluşturulamaz. ALICI, kayıt sırasında vermiş olduğu elektronik posta adresini kullanıcı adı olarak kullanacak ve kendi belirleyeceği şifreye sahip olacaktır. ALICI,şifresini dilediği zaman değiştirebilir. Şifre seçimi, değişimi ve korunmasına dair sorumluluk tamamen ALICI’ya aittir.

ALICI, üyelik oluşturulması ve hizmetlerin kullanılması sırasında, gerek kendisi gerek velisi olduğu küçükler için alt kullanıcılar oluşturabilir. ALICI, bodhicore’a bildirdiği tüm bilgilerin doğru olduğunu ve bu bilgilerin gerekli olduğu durumlarda hatalı veya noksan olmasından kaynaklanabilecek sorunlardan bodhicore’un bir sorumluluğu bulunmadığını kabul, beyan ve taahhüt eder.ALICI’nın bilgilerinde değişiklik olması halinde söz konusu bilgilerin güncellenmesi ALICI’nın sorumluluğundadır.

ALICI, Sözleşme konusu Dijital İçerik Hizmetleri’ni belirlediği kullanıcı adı ve şifrenin girilmesi suretiyle kullanabileceğini, kullanıcı adı ve/veya şifrenin hatalı girilmesi nedeniyle hizmetlerin kullanılamamasından bodhicore’un sorumlu olmadığını kabul, beyan ve taahhüt eder.

ALICI, şifre ve kullanıcı adının gizli kalması için gerekli dikkat ve özeni göstereceğini, şifreyi ve kullanıcı adını herhangi bir üçüncü kişiye açıklamayacağını, kullandırmayacağını, şifresinin yetkisiz üçüncü kişiler tarafından ele geçirildiğini öğrenmesi veya bundan şüphelenmesi halinde derhal bodhicore’a haber vereceğini, şifre ve kullanıcı adının üçüncü şahıslar tarafından kullanılması sebebiyle doğacak zararlardan bodhicore’un sorumlu olmayacağını kabul ve taahhüt eder.

TARAFLARIN BEYAN VE TAAHHÜTLERİ

ALICI, işbu Sözleşme’nin yürürlüğe girmesiyle birlikte, Sözleşme konusu Dijital İçerik Hizmetleri’ni satın alarak, www.bodhicore.comve uygulamalarında belirtilen kullanım şartları ve sınırlandırmalar kapsamında hizmet alma hakkını elde etmiştir.

ALICI, bodhicore’un sunduğu ve 5846 sayılı Fikir ve Sanat Eserleri Kanunu’na uygun olarak mali haklarına/kullanım yetkisine/lisans haklarına sahip olduğu Dijital İçerik Hizmetleri’nin ancak işbu Sözleşme şartları kapsamında bireysel amaçla kullanılabileceğini ve Sözleşme ile açıkça belirtilmemiş hiçbir yetkinin ALICI’ya devredilmemiş olduğunu kabul, beyan ve taahhüt eder.

Bodhicore’un işbu Sözleşme kapsamında Dijital İçerik Hizmetleri sunuyor olmasının, ALICI’ya donanım ve/veya yazılım temini veya mevcut donanım ve/veya yazılımın düzgün çalışması konusunda bir taahhüt ya da garanti verdiği anlamına gelmemektedir.

Bodhicoreteknik sorun ve/veya geliştirmelerden kaynaklanan nedenlerle herhangi bir zamanda sistemin çalışmasını ve hizmetlerin verilmesini geçici olarak askıya alabilecek veya tamamen durdurabilecektir. ALICI, bu nedenle hizmetlerin geçici bir süre için askıya alınmasından dolayı bodhicore’dan herhangi bir nam altında tazminat ve benzeri hak ve bedel talep etmeyeceğini kabul, beyan ve taahhüt eder.

Bodhicore’un sunduğu Dijital İçerik Hizmetleri, sektörel standartlar paralelinde, mümkün olduğunca kesintisiz, sürekli, güvenli ve kaliteli olacaktır. ALICI, internette yaşanan kesintiler, hız düşmesi ve benzeri sebeplerle hizmette yaşanacak kesinti, görüntü kalitesi ve güvenlik problemlerinden ve/veya ülkede genel bir karışıklığın ortaya çıkması savaş, terör, grev, genel elektrik kesintisi, deprem, su baskını, olağanüstü hal, siber saldırı, cihazlara virüs bulaşmış olması veya benzeri bir mücbir sebeple hizmetin verilmesine ilişkin yaşanacak sorunlardan bodhicore’un sorumlu olmayacağını kabul ve taahhüt eder.

BodhicoreDijital İçerik Hizmetlerini sunduğu internet sitesine ait alan adını ve internet sitesi ve/veya uygulamaların görünümünü, içeriğini ve dijital içerikleri her zaman için değiştirme hakkını saklı tutar.

ALICI, bodhicore’un teknik zorunluluklar veya mevzuatta meydana gelecek değişiklikler ve benzeri zorlayıcı sebeplerle, işbu Sözleşme hükümlerini tek taraflı olarak değiştirebileceğini, yeni maddeler ekleyebileceğini veya maddeleri çıkarabileceğini kabul, beyan ve taahhüt eder.

ALICI, işbu Sözleşme ile faydalanmak istediği ücretli hizmetlerden faydalanabilmek için bilgisayarının yahut ürün ve/veya hizmeti kullanacağı diğer elektronik cihazlar ile teknik donanımının hizmetlere uygun gerekli asgari kriterleri karşıladığını, bu kriterlere uygun olmayan bilgisayar ve/veya teknik donanım sebebiyle hizmetlerden faydalanamama durumunda, bodhicore’dan herhangi bir sorumluluğunun olmadığını, herhangi bir nam altında bodhicore’dan herhangi bir talepte bulunmayacağını kabul, beyan ve taahhüt eder.

ALICI, verilen hizmetin internet üzerinden veri akışı ile gerçekleşen bir hizmet olduğunu, ALICI’nın hizmetlerden yararlandığı sırada bağlantı kurduğu internet paketinin kotasının bu durumdan etkileneceğini ve bodhicore’un oluşabilecek erişim giderleri, kota aşımı ve sonuçlarından sorumlu olmadığını kabul, beyan ve taahhüt eder.

KİŞİSEL VERİLERİN KORUNMASI

Bodhicore, ALICI’ya daha iyi hizmet verebilmek ve ürün sunabilmek adına ve ALICI’nın beklentilerine daha uygun içerikler sağlamak amacıyla,  6698 sayılı Kişisel Verilerin Korunması Kanunu, 6563 Sayılı Elektronik Ticaretin Düzenlenmesi Hakkında Kanun, 5237 Sayılı Türk Ceza Kanunu 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği’nden doğan yükümlülükleri kapsamında www.bodhicore.comve uygulamaları veya çağrı merkezi üzerinden ALICI’nın yahut kanuni temsilcisi olduğu alt kullanıcıların alt adı, soyadı, doğum tarihi, adresi, telefon numarası, elektronik posta adresi gibi özel nitelikli olmayan kişisel verileri kaydetmektedir.

Bodhicore, kişisel veri sahibi olan ALICI’yı aydınlatmakla yükümlü olup, bu kapsamda ALICI, işbu sözleşmeyi, www.bodhicore.com internet sayfasında yer alan Gizlilik ve ilgili Politikalarını okuduğunu ve bodhicore’un 6698 sayılı Kişisel Verilerin Korunması Kanunu (bundan sonra“KVKK” olarak anılacaktır.)’ndan doğan aydınlatma yükümlülüğünü yerine getirdiğini kabul ve beyan eder. ALICI, işbu sözleşmeyi kabul etmesiyle beraber kişisel verilerinin işlenmesine, aktarılmasına ve saklanmasına icazet etmiş sayılır.

ALICI, üyelik süresince kendisi tarafından aktarılan kişisel verilerinin doğru ve gerektiğinde güncel olmasını sağlama yükümlülüğünü kabul ve taahhüt eder.

Bodhicore, ALICI’nın aktardığı kişisel verileri (kendisinin ve kanuni temsilcisi olduğu küçüklerin), işbu Sözleşme kapsamı ve amacı ile sınırlı olarak işleyeceğini, aktaracağını ve saklayacağını kabul ve taahhüt eder. Bodhicore, işbu Sözleşme kapsamında kendisine aktarılan kişisel verileri ürün ve hizmetlerin doğru bir şekilde sunulması amacı ile ve tüketici sorularına yanıt vermek üzere, elektronik posta, posta veya telefon yoluyla kullanabilir. Bodhicore, ALICI’nın kendisine aktardığı kişisel verileri pazarlama faaliyetleri ve benzeri amaçlarla yasal sınırlamalar dahilinde haberleşme amacı ile, e-posta, posta veya telefon yoluyla kullanabilir.

Bodhicore, ALICI’lara daha iyi hizmet verebilmek amacıyla ve yasal yükümlülüğü çerçevesinde, işbu Sözleşmenin eki olan Kişisel Verilerin Korunması Hakkında Açıklama metninde belirlenen amaçlar ve kapsam dışında kullanılmamak kaydı ile gezinme bilgilerinizi toplayacak, işleyecek, üçüncü kişilerle paylaşacak ve güvenli olarak saklayacaktır.

Uygulama çerezleri; günlük dosyaları, boş gif dosyaları ve/veya üçüncü taraf kaynakları yoluyla topladığı bilgileri tercihlerinizle ilgili bir özet oluşturmak amacıyla depolar. Uygulamada ALICI’ya yahut alt kullanıcılara özel tanıtım yapmak, promosyonlar ve pazarlama teklifleri sunmak, web sitesinin veya mobil uygulamanın içeriğini iyileştirmek ve/veya tercihlerini belirlemek amacıyla; uygulamada gezinme bilgilerini ve/veya kullanım geçmişini izleyebilmektedir.

çevrimiçi ve çevrimdışı olarak toplanan bilgiler farklı yöntemlerle veya farklı zamanlarda Uygulama üzerinde toplanan bilgileri eşleştirebilir ve bu bilgileri üçüncü taraflar gibi başka kaynaklardan alınan bilgilerle birlikte kullanabilir

Bodhicore, ALICIbilgilerini 3. kişilere aktarabilir. ALICI verilerinin aktarımı hususunda Kişisel Verilerin Korunması ve İşlenmesi Politikası’na yer alan usul ve esaslar uygulanır. 3. kişiler ile paylaşılan kişisel veriler ürün ve hizmetlerin sunumu ve hizmet kalitesinin artırılması amacına yöneliktir. ALICI’nın kişisel verileri işbu Sözleşme’nin amacı dışında işlenemez. Bodhicore, ALICI’nın kişisel verilerini işbu sözleşmede mezkur amaçlar dışında kullanmalarına olanak verecek şekilde satmayacak ve açıklamayacaktır. KVKK’da öngörülen istisnai haklar saklıdır.

Bodhicore, KVKK’nın öngördüğü iç ve dış denetimleri yaptıracağını taahhüt eder.

ALICI’nın, bir ücrete tabi olmadan kişisel verilerine erişim hakkı bulunmaktadır. ALICI, bodhicore.com adresinden (veya internet sitesinde bulunan form aracılığı ile) irtibata geçerek; KVKK’dan doğan haklarını talep edebilir. Bodhicore, ALICI’ya makul süre içerisinde cevap verecektir.

ALICI’nın çerez uygulamalarını kabul etmesi halinde çerezler, www.bodhicore.cominternet adresinde yer alan Çerez Politikası’na uygun şekilde ALICI’nın cihazına yerleştirilir.

Bodhicore, ALICItarafından yapılan kişisel verilerinin işlenmesi, aktarılması ve/veya muhafaza edilmesi ile ilgili talepleri niteliğine göre en kısa sürede ve her halükarda en geç 30 (otuz) gün içinde ücretsiz olarak sonuçlandırır. Bu sürenin başlayabilmesi için ALICI talebini yazılı veya Kişisel Verileri Koruma Kurulu’nun belirlediği diğer yöntemlerle bodhicore’a göndermelidir. Talebin bodhicore tarafından reddedilmesi, verilen cevabın yetersiz bulunması veya süresinde cevap verilmemesi hallerinde; ALICI cevabı öğrendiği tarihten itibaren 30 (otuz) gün ve her halükarda başvuru tarihinden itibaren 60 (altmış) gün içinde Kişisel Verileri Koruma Kurulu’na şikayette bulunabilir.

HİZMET BEDELİ

ALICI, seçtiği Dijital İçerik hizmet kategorisine göre www.bodhicore.com web sitesinde bodhicore tarafından açıklanan, taahhütlü veya peşin olarak sunulan ücretli içerik hizmetlerine ilişkin hizmet bedellerini, bildirilen şekillerde ödemeyi, bu ödemeyi yapmadıkça bodhicore’un sunmuş olduğu hizmetlerden yararlanamayacağını kabul ve taahhüt eder.

ALICI, işbu Sözleşme kapsamında satın alacağı hizmetin www.bodhicore.com web sitesinde yayınlanmış olan hizmet bedelinin ödemesini Kredi Kartı bilgileri ile online olarak veya banka havalesi/EFT/FAST/SWİFT yollarından biriyle yapacaktır. Hizmet bedellerinde veya vergi oranlarında meydana gelen değişiklikler bodhicore tarafından hizmet bedellerine yansıtılacaktır. Bunlarla sınırlı kalmamak üzere bodhicore her zaman ürün ve/veya hizmet bedellerinde değişiklik yapma hakkına sahiptir. ALICI, hizmet bedellerinde meydana gelebilecek bu değişiklikleri kabul etmediği takdirde işbu Sözleşme’yi 5 gün içerisinde feshetmek hakkını haizdir. Bu süre içerisinde işbu Sözleşme’yi feshetmeyen ALICI, hizmet bedeline ilişkin değişikliği kabul etmiş sayılır.

DAMGA VERGİSİ

İşbu Sözleşme’nin ALICI tarafından kabul edilmesi halinde, tahakkuk edecek damga vergisi tutarının yarısı ALICI’nın hizmet bedeli faturasına yansıtılarak ALICI’dan tahsil edilecektir.

CAYMA HAKKI VE ALICININ HİZMETİ SONLANDIRMASI

Bodhicore’un işbu Sözleşme konusu ürün ve/veya hizmetleri Mesafeli Sözleşmeler Yönetmeliği’nin 15/ğ hükmü gereğince elektronik ortamda anında ifa edilen ve tüketiciye anında teslim edilen gayri maddi mal niteliğinde olduğundan Cayma Hakkı kapsamında bulunmamaktadır. ALICI, bu hususu en başından bildiğini ve Cayma Hakkı talep etmeyeceğini kabul ve taahhüt eder.

TEMERRÜT HALİ VE HUKUKİ SONUÇLARI

ALICI, faturalarını zamanında, gereği gibi veya hiç ödememesi halinde temerrüde düşmüş sayılacaktır. ALICI’nın temerrüde düşmesi halinde, ALICI aylık %3 oranında akdi gecikme faizi ile birlikte söz konusu faturaları ödemekle sorumlu olacaktır. Gecikme bedeli, gecikmenin ilgili olduğu faturanın ödenmesinden sonra günlük olarak hesaplanıp ALICI’nın takip eden ilk faturasına yansıtılır. Söz konusu faiz oranındaki değişikliklere faturada yer verilecek olup, gecikme durumunda değişen yeni oran uygulanacaktır.

SÖZLEŞMENİN SONA ERMESİ VE FESİH

Bodhicore, ALICI’nın işbu Sözleşme’den doğan yükümlülüklerini Ön Bilgilendirme Formu ve işbu sözleşme’de belirtilen şekilde yerine getirmemesi halinde süre vermeksizin sözleşmeyi feshedebilir. Ayrıca bodhicore, iş modellerindeki değişikliklere bağlı olarak tamamen ve tek taraflı kararı ile işbu Sözleşme konusu ürün ve/veya hizmeti üyelerine sunmaktan vazgeçebilir ve hizmet sunumunu sona erdirebilir. Bu durumda ALICI’nın hiçbir nam altında bodhicore’dan herhangi bir bedel talep etme hakkı olmayacaktır.

ALICI, Dijital İçerik Hizmetlerini hiçbir şekilde bireysel kullanım amacı dışında kullanamaz ve/veya kullandıramaz, 3. kişi ve/veya kurumlara iletemez, kullandıramaz ve/veya devredemez. Bodhicore tarafından yetkisiz bir kullanımın tespiti halinde işbu Sözleşme kapsamında sunulan hizmetler derhal durdurulabilir ve işbu Sözleşme hiçbir ihtara gerek kalmaksızın tek taraflı olarak feshedilebilir. Bu durumda bodhicore zararlarının tazminini ve sair yasal haklarını talep etme hakkı saklıdır. İşbu sözleşme konusu haklar ALICI tarafından hiçbir surette ticari amaçlara konu yapılamaz.

ALICI, işbu Sözleşmeyi feshetmek istediği takdirde bodhicore’a yazılı bildirimde bulunmak suretiyle üyeliğini sonlandırabilir. Böyle bir durumda ALICI, ilgili aya ilişkin olarak ödemiş olduğu hizmet bedelinin geri verilmesini talep etmeyeceğini, kampanya kapsamında taahhüt süresinden evvel üyeliğini iptal etmesi halinde yararlandığı indirim ve avantajların kendisine faturalanacağını kabul ve taahhüt eder.

ALICI, tek taraflı olarak üyeliğini sonlandırdığında, işbu Sözleşme kapsamında verdiği kişisel verilerinin silinmesini, yok edilmesini veya anonim hale getirilmesini talep edebilir. ALICI’nın kişisel verilerinin silinmesine, yok edilmesine veya anonimleştirilmesine ilişkin talepler bodhicore’un Kişisel Verilerin Korunması ve İşlenmesi Politikası tarafından öngörülen usul ve esaslara göre değerlendirilir.

UYUŞMAZLIKLARIN ÇÖZÜMÜ

İşbu Sözleşmeden kaynaklanabilecek ihtilaflarda İstanbul (Çağlayan) Mahkemeleri ve İcra Daireleri yetkilidir. Ayrıca ALICI, şikayet ve itirazları konusundaki başvurularını, Bakanlıkça her yıl Aralık ayında belirlenen parasal sınırlar dahilinde mal veya hizmeti satın aldığı veya ikametgahının bulunduğu yerdeki tüketici sorunları hakem heyetine veya tüketici mahkemesine yapabilecektir. Kişisel verilere ilişkin taleplerde 6698 sayılı Kanun’un öngördüğü şikayet ve itiraz usulleri saklıdır.

YÜRÜRLÜK

İşbu Sözleşme, ALICI tarafından okunarak, kabul edildiği anda yürürlüğe girecek ve Taraflardan herhangi biri tarafından feshedilinceye kadar yürürlükte kalacaktır.
